Welcome to SummerBoss! These Terms of Service ("Terms") govern your access to and use of the SummerBoss website, mobile applications, and services (collectively, the "Service") operated by SummerBoss ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Eligibility
You must be at least 13 years old to use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
By using our Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.
2. Account Registration
To access certain features of our Service, you may need to create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that contain inaccurate information or that we believe violate these Terms.
3. Description of Service
SummerBoss is a platform that helps families discover, compare, and plan summer camp experiences. Our Service includes:
- A searchable directory of summer camps and programs
- Tools to save and compare camps
- Summer planning and scheduling features
- Reminders and notifications about camps and deadlines
- Information and resources about summer activities
We provide information about camps and organizations but are not responsible for the camps themselves. Camp availability, pricing, policies, and quality are determined by the individual camp organizations.
4. Acceptable Use
You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable law or regulation
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
- Use any robot, spider, scraper, or other automated means to access the Service without our express written permission
- Collect or store personal data about other users without their consent
- Use the Service to send unsolicited communications (spam)
- Upload or transmit viruses or any other malicious code
5. User Content
Our Service may allow you to submit, post, or share content, such as reviews, comments, or other materials ("User Content"). You retain ownership of your User Content, but by submitting it, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.
You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate the rights of any third party.
We reserve the right to remove any User Content that we believe violates these Terms or is otherwise objectionable, without prior notice.
Photos and other media uploaded by camp organizations ("Camp Media") are governed by the photo and facial-recognition terms in Section 6.
6. Camp Photos, Galleries, and Facial Recognition
Camp-uploaded content. Camps and their authorized staff may upload photos and other media from camp sessions ("Camp Media") to galleries visible to enrolled families. Camps are responsible for the Camp Media they upload, including obtaining any necessary permissions and honoring their own photo/media-release policies. SummerBoss stores and displays Camp Media on the camp's behalf.
Your use of Camp Media. Galleries are provided for the personal, non-commercial use of enrolled families. You may download photos of your own family for personal use. You agree not to redistribute, publish, sell, or use Camp Media depicting other people's children without their consent, and not to use any automated means to scrape galleries.
Facial recognition (optional, opt-in). Where offered, facial recognition is strictly optional and requires your explicit, separate consent per child before any biometric identifier is created. You may revoke consent at any time. Our collection, use, storage, and destruction of biometric identifiers are described in our Privacy Policy and Biometric Policy.
Removal. You may request removal of photos depicting your child; we will work with the camp to honor reasonable requests.
7. Third-Party Content and Services
Our Service displays information about summer camps and organizations provided by third parties. We do not control and are not responsible for the accuracy, completeness, or quality of this third-party content.
Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your interactions with third-party websites are solely between you and the third party.
Important: We do not endorse, guarantee, or assume responsibility for any camp, organization, or program listed on our Service. You should independently verify all information and conduct your own due diligence before registering for or attending any camp.
8. Waitlist and Beta Features
We may offer early access, waitlist, or beta features that are still in development. These features:
- Are provided "as is" without any warranties
- May be modified, suspended, or discontinued at any time without notice
- May contain bugs, errors, or other issues
- Are not guaranteed to become generally available
By participating in our waitlist or using beta features, you acknowledge these limitations and agree to provide feedback to help us improve the Service.
9. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of SummerBoss and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
Information about camps, including availability, pricing, schedules, and policies, is provided for informational purposes only and may be inaccurate or out of date. Always verify information directly with the camp organization.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUMMERBOSS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Any experiences at camps or programs found through the Service
Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
12. Indemnification
You agree to defend, indemnify, and hold harmless SummerBoss and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party right, including any intellectual property or privacy right
- Any claim that your User Content caused damage to a third party
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Davidson County, Tennessee. You consent to the personal jurisdiction and venue of such courts.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on our Service at least 30 days before the changes take effect.
Your continued use of the Service after any changes become effective constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using the Service.
